Criminal
Law
We have
substantial experience defending the rights of people
arrested and accused of criminal offenses. We handle all
types of criminal cases, including non-indictable
misdemeanors (called "disorderly persons offenses" in New
Jersey and prosecuted in municipal courts) and indictable
felonies (called "crimes" in New Jersey and prosecuted in
Superior Court). Specific types of cases for which we can be
retained include but are not limited to: drug
possession/sale; theft/larceny, fraud/embezzlement
(including "white collar" cases), sex offenses, arson and
related cases, assault, harassment and conspiracy. We also
handle expungements of criminal records, including
convictions and arrest records. There are two types of cases
related to criminal law, however, which deserve special
note.
Firearms: In New Jersey, all of the basic firearms
statutes are in the Criminal Code, which is a good indicator
of the governmental bias against gun owners. Prosecutors and
police never give up the chance to gain title to or destroy
an individual's firearms, as well as prevent an individual
form purchasing firearms in the future, no matter how
specious the claim. They do it because they can - until they
are stopped. We have extensive experience in representing
gun owners with their legal concerns, which can be
classified into three major areas: permit appeals (denials
of permit applications or revocation of current permits);
firearms seizures and confiscations (usually but not always
as a result of domestic violence restraining orders) and
possessory offenses ("assault firearms" and "high capacity
magazines," etc.). We have also represented firearms
organizations in legal actions against municipalities. It is
very important with these types of cases to retain an
attorney who has both an interest and experience in
defending your firearms rights.
Juvenile Criminal Cases: Juvenile Criminal Cases are
handled in Family Court, not Criminal Court, and are always
classified as "Juvenile Delinquency" actions. These actions
are based on the Code of Criminal Justice, which adds a
substantial number of provisions to the underlying offenses
defined in other statutes (in the Criminal Code). The
discretion granted to the court in juvenile delinquency
actions, especially with sentencing and diversionary
programs, is much greater than with adult criminal cases.
This is why choosing an attorney with specific experience in
this body of law is very important.
